CULTUREEDIT Online Auction Terms & Conditions

CULTUREEDIT Online Auction Terms and Conditions

1. Introduction

Welcome to CULTUREEDIT. These Terms & Conditions govern your participation in all CULTUREEDIT online auctions. By registering, bidding, or using our platform, you agree to be bound by these terms.

2. Eligibility & Registration

  • You must be at least 18 years old to participate.

  • You agree to provide accurate, current, and complete information during registration.

  • You are responsible for maintaining the confidentiality of your account and all activity under it.

3. Bidding Rules

  • All bids placed on CULTUREEDIT are legally binding offers to purchase.

  • Bids cannot be withdrawn once submitted, except at our sole discretion.

  • CULTUREEDIT may set minimum bid increments and other bidding requirements.

  • Any form of bid manipulation, including fake or “shill” bidding, is strictly prohibited.

4. Reserve Price & Bid Acceptance

  • Some items may be subject to a reserve price.

  • For all CULTUREEDIT auctions, where a reserve price applies, acceptance of the highest bid is at our sole discretion.

  • The highest bid does not automatically constitute a winning bid unless it is expressly accepted by CULTUREEDIT.

  • The bidder will be notified if their bid has been accepted as the winning bid.

5. Auction Process

  • Auctions are conducted for a specified period.

  • CULTUREEDIT reserves the right to extend, pause, or cancel auctions at any time.

Popcorn Bidding:

  • Certain auctions may feature “popcorn bidding” (also known as extended bidding), where bids placed within the final moments of an auction will automatically extend the auction closing time.

  • The duration of each extension and the conditions under which it applies are determined solely by CULTUREEDIT.

  • The highest accepted bid at the close of the auction will be deemed the winning bid.

6. Payment Terms

  • After the close of the auction, CULTUREEDIT will send the winning bidder an invoice for the lot by email.

  • Payment is due within 48 hours of that invoice.

  • Invoices are issued and paid through the CULTUREEDIT store; accepted payment methods are shown on the invoice.

  • Shipping and insurance are not included in the lot invoice and are quoted and billed separately (see Section 8).

  • Failure to complete payment within 48 hours may result in cancellation of the sale, release of the lot to the underbidder, account suspension, and/or additional fees.

7. Fees & Charges

  • Applicable taxes, shipping, and handling charges are the responsibility of the buyer unless otherwise stated.

8. Shipping & Delivery

  • Shipping and insurance costs will be invoiced separately after the close of the auction.

  • CULTUREEDIT will follow up promptly with the winning bidder to arrange shipping and insurance.

  • Shipping terms, costs, and timelines will be confirmed during this process.

  • For framed artworks, additional packing and handling charges may apply to ensure safe and secure delivery of the piece.

  • Risk of loss may transfer to the buyer upon shipment.

  • CULTUREEDIT is not responsible for delays caused by shipping carriers or customs.

Insurance Waiver:

  • If the buyer declines to purchase shipping insurance, they expressly assume all risk of loss or damage during transit.

  • By opting out of insurance, the buyer waives any and all claims against CULTUREEDIT related to lost, stolen, or damaged items in transit.

Pre-Shipping Inquiries:

  • All questions or concerns regarding an item, including condition, provenance, or other details, must be addressed prior to shipment.

  • Once the item has been shipped, no further inquiries or claims regarding these matters will be considered, except as otherwise required by law.

9. Communications

  • All communication regarding auctions must be conducted via email.

  • CULTUREEDIT does not conduct auction-related business over social media platforms and is not responsible for missed phone calls or voicemails.

  • Bidders are responsible for ensuring their email accounts are active and monitored for all auction communications.

10. Item Descriptions & Condition

  • All items are sold “as is” unless explicitly stated otherwise.

  • While CULTUREEDIT strives for accuracy, we do not guarantee that item descriptions are free from errors.

  • Bidders are responsible for reviewing all item details prior to placing a bid.

11. Returns & Refunds

  • All sales are final unless otherwise specified.

  • Refunds may be issued only in cases of non-delivery or significant misrepresentation, subject to review.

12. Prohibited Conduct

Users may not:

  • Engage in fraudulent or deceptive practices

  • Interfere with the proper functioning of the auction

  • Use multiple accounts to manipulate bidding

14. Limitation of Liability

  • CULTUREEDIT is not liable for any indirect, incidental, or consequential damages arising from the use of the platform.

  • Our total liability shall not exceed the amount paid by the user for the item in question.

15. Dispute Resolution & Arbitration

  • Any disputes, claims, or controversies arising out of or relating to CULTUREEDIT auctions or these Terms & Conditions shall be resolved exclusively through binding arbitration.

  • By participating in the auction, you agree to waive any right to pursue disputes in court or to participate in class actions.
